Builder in ‘connivance’ with some NIT bosses cheat, rob Rajat Height owners on Koradi Rd

The residents lodge complaint with the Department of Administrative Reforms and Public Grievances, Government of India after failing to get justice from NIT, NMC

Nagpur News: The Nagpur Improvement Trust (NIT) authorities have left the residents residing on Koradi Road area which comes under NIT red-faced by indulging in illegal actions. The NIT authorities in the revised plan removed the previously proposed land shown in plan for construction of flat schemes by the builder Kishore Rai, and, the builder later sold the removed land from the previous proposed plan allegedly in connivance with NIT authorities thus robbing the residents of public utility (PU) land and the playground. The two buildings are occupied by 128 flat owners under a scheme and 68 apartment owners in another scheme.

The residents lamented that leave alone the builder, the authorities of NIT and NMC as well have turned a Nelson’s eye to their grievances and are not initiating any tangible solution to the crucial issue. Similarly, they are being starved of basic amenities since 2009. The Rajat Height scheme of the builder Kishore Rai comes under NIT.

However, the residents, not to be suppressed by the “tricky deals” of the builder and the concerned NIT authorities, lodged a strongly worded complaint, through one of the flat owners, Rajeev Ranjan Kushwaha, Flat No. 101, Wing-1, Rajat Height, to Department of Administrative Reforms and Public Grievances, Government of India, with a request to look into the matter and provided justice to the residents of the flat schemes by way of action against the builder Kishore Rai and the concerned NIT authorities. The residents have demanded return of the PU land the playground to them and provide the basic amenities to the apartment owners of Rajat Height. The complainant, Rajeev Ranjan Kushwaha, has urged the Department of Administrative Reforms and Public Grievances, Government of India, to initiate stringent action against the builder and the concerned NIT bosses according to the law and recover hefty fine from them for their illegal activities. The residents further informed that they had paid Rs 10,000 each to builder for membership for the flats. The Department of Administrative Reforms and Public Grievances, Government of India should set up a society and the entire amount should be deposited in the society account, urged the aggrieved residents. “You are the only hope for us. Others have harassed us, and are awaiting justice from you,” the residents of Rajat Height pleaded. There are also at least 140 various shops or establishments situated in the two buildings.

The all important fact is that the entire land comes under NMC after the 1900 layouts were regularized by the NIT by implementing a directive from Maharashtra Government in this regard.

The Department of Administrative Reforms and Public Grievances, Government of India, taking the issue seriously, forwarded the complaint to Maharashtra Government. It may be recalled Kishore Rai of the Rai Group of Industries launched an ambitious flat scheme Rajat Height on Koradi Road during Deepawali festivities in 2006. The builder lured the citizens by offering the flats at the cost of Rs 3.51 lakh and the shops Rs 2.50 lakh. However, the builder recovered an additional amounts between Rs 1.50 lakh and Rs 2.50 lakh by various means. The builder constructed two buildings have seven stories each and 140 shops and 128 flats in the building facing the road. The other building consists 68 flats. The builder called all the flat owners and the shop owners at his office and started handing over ownership documents to respective flat as well as shop owners without showing the actual construction of the flats and shops. The flat and shop owners were shocked over the inferior quality of material used in the construction, and that too, without proper facilities like no security walls around the complex, proper electric supply arrangements, no lifts, no development of PU land, and the most frustrating fact of continued water supply nor the reservoir to store water for the flat residents only.

The builder had recovered Rs 10,000 each from the owners for setting up of a society but neither the society was set up nor the amount was returned to the owners. The builder allegedly gobbled up the entire amount which comes to at least Rs 4-5 crore.

However, when the residents approached the builder for resolving various important issues the builder humiliated them by asking them to leave the office immediately or face the action.

On the other hand, if the NMC acts tough against the builder by recovering Property Tax of 192 flats and 140 shops since past seven years from the builder the NMC could mop up crores of rupees apart from Rs 40,000 per month on water connection count. The massive buildings have no facility to tackle fire incidents, and the NMC could force the builder to install proper firefighting machineries so that anu fire incident could be handled and any tragedy averted, the residents asserted.
