Nagpur: Special Judge OP Jaiswal on Monday sentenced a 45-year-old man to 20 years of Rigorous Imprisonment (RI) for raping his 12-year-old biological daughter. The step-mother too was convicted for concealing information.
The judge, while passing the verdict, also urged the convicted couple to deposit the fine amount with the court for the “purpose of education” of the daughter.

As per the prosecution, the man had tied up and gagged his minor daughter, then a Std VI student, before raping her in November 2019. He had also threatened her of dire consequences if she revealed this to anyone.
The incident took place when the father-daughter duo was alone at home. The girl was changing when her father grabbed her from behind and forced her into a physical relationship with him. In February 2020, the man once again forced himself upon her.
As per the statement of the minor, her father had also performed unnatural sex with her during the rape.
It’s learnt the girl, born to man’s second wife, had come to stay with him in 2011 after her biological mother married another man. Her father had two sons from his first wife whom he had abandoned in 2007. His second marriage was with his first wife’s cousin.
The girl had narrated her ordeal to her father’s first wife but, it is learnt, she had suggested her to refrain from making the matter public.
The court, under section 21 of the Protection of Children from Sexual Offences (POCSO) Act, 2012, has convicted the step mother ordering her to remain present in the court till the end of the working hours and also imposed fine of Rs 5,000.
The case was registered at Umred police station of Nagpur rural in March 2020.
Addl and special public prosecutor Rashmi Khaparde said nine witnesses were examined by her. “The rape survivor herself had narrated her plight during the deposition,” said she.
The court has awarded 20 years in jail and fine of Rs1,000 under 376 (AB) of Indian Penal Code (IPC). Under section 376 (2) of IPC, the special court has sentenced the man for 10 years of imprisonment and fine of Rs1,000. Equal quantum of punishments under 376 (2) (f) of IPC was also slapped on the man sentencing him for 10 years of imprisonment with fine of Rs1,000 to run concurrently.
The court has also convicted the man for unnatural sex on daughter slapping him with an imprisonment of five years and Rs1,000 as fine. The man was also convicted under different provisions of POCSO Act, 2012.
