Dr Bagga Granted Bail

Smt. Bagrodia judge granted bail to the accused Dr. Gaurav Bagga who is a co – accused in the infamous gaming app scam, wherein Sontu @ Anant Jain is the prime accused. An FIR was filed against Sontu @ Anant Jain for having cheated the complainant, whereby it was alleged that Sontu Jain has pocketed approximately Rs. 58 Crores from complainant by practicing fraud in the gaming app. The complainant alleged that he had passed over the said amount to Sontu Jain and that after figuring out the fraud in the app, whereby, whenever the complainant used to win in the said app, the said app used to crash and as such, the complainant could never encash the winning booty.

Based upon the said complaint, an FIR was registered with the cyber cell and Sontu Jain and his family members were arrayed as accused. The prosecution contended that, based upon a secret information, it transpired that Sontu Jain and his family members had a locker with a bank at Gondia and as such the prosecution contended that, they had intimated the manager at the bank to freeze the said accounts and locker.

Against this, the manager of the bank in connivance with the manager of another bank at Bhandara and as per the directions of Sontu Jain took Dr. Bagga and his wife Dr. Garima Bagga in confidence and opened lockers in the name of the Bagga couple and shifted the gold and cash component from the lockers of the Jain family to the locker of the Bagga couple and subsequently, in connivance with the Bagga couple, the manager of the bank had passed over the belongings of the locker to one person as directed by Sontu Jain and the entire episode had been captured in the CCTV of the bank. The prosecution further alleged that from the retrieved conversations from the mobile phone of Sontu Jain, which had been deleted by him, it transpired that Sontu Jain had assured to give Rs. 4 Crores to bank manager for abetting the transfer from the locker, which subsequently he did not pay on account of the fight that ensured between him and the manager.

Adv Surabhi Naidu (Godbole) and Mayank Gupta appearing on behalf of Dr. Gaurav Bagga contended before the court that the doctor was subjected to sufficient days of police custody remand and he had fully cooperated with the investigating machinery and that immediately after his arrest the investigating machinery had thoroughly searched his premises and had seized gold ornaments worth approximate Rs. 3 crores and that no recoveries remained to be effected from this accused and that during interrogation he had honestly cooperated and disclosed all whereabouts which were in his knowledge. It was further contended that since the investigation in the crime was complete in all perspectives, custodial detention of the accused was squarely unwarranted and that no purpose would be served by languishing the accused behind bars and that since the accused happens to be an utmost respectable member of society, with deep roots in the society and possessed landed properties and blood relatives, there was absolutely no chance of the accused fleeing from justice in the event the court proceeds to release him on bail. Appreciating the contentions of the prosecution and defence, the court proceeded to direct the release of Dr. Gaurav Bagga on bail. Adv Prakash Naidu, Mayank Gupta, Surabhi Naidu (Godbole), Homesh Chauhan, Mitesh Bais appeared for accused persons.
