Nagpur: All seven accused namely Abhilash Krishna Khopde, Rohit Khopde, Mohsin Ramesh Khedikar, Girish Padmakar Giridhar, Rahul Rakesh Yadav, Akshay Subhash Lode and Swapnil Deshmukh were released on bail by Justice P N Deshmukh. However, Justice P N Deshmukh directed all of the accused to furnish a solvent surety of Rs 25000 each with conditions to attend Ambazhari Police Station every alternate day till the filing of the Charge Sheet and directed them to remain present with police for identification parade on December 21, 2016 in between 11 am to 5 pm.
It was argued by Defence Counsel that the First Information Report (FIR) is false and was an act of counter blast to save themselves in the murder case of innocent boy Shubham Mahakalkar and deadly assault on Akshay Khandare.
There was a simple injury on the scalp to owner of Cloud-7 Bar and Restaurant Sawan alias Sunny Bamrotwar and there is no prima facie Case under Section 307 since there is no sufficient injury which may cause death in ordinary course of nature and both private hospital specifically gave opinion of simple hurt even independent witnesses had claimed that Sunny Bamrotwar was the aggressor.
The Government Pleader Bharti Dangre argued that accused persons were aggressive n there are two separate incidences. Advocate Sunil Manohar, Advocate Prakash Jaiswal, Advocate Uday Dable and Advocate Rajesh Tiwari appeared for the accused persons.
