Arrogant deal with complainant, soft deal with defaulter

Rajat Heights builder embezzles service tax and society formation fee 

Nagpur: The incident of arrogantly dealing with complainants and softly dealing with defaulter came to surface at 11 am on November 17 in Income Tax office, Saraf Chambers, Sadar, here in the city when the complainants were humiliated by IT staff.

In fact, the complainants were called at IT office on the aforesaid date and time through official intimation, citing various rules and regulations, on the basis of the complaint which they had filed about three months ago. An IT staffer flatly told the complainants that there was no body in the office to attend to them as all IT officials had gone to city to execute certain major work. The staffer roughly asked the complainants to go away and come again whenever called. Feeling humiliated, the complainants argued with the staffer that they had come there as complainants against the defaulter, but the staffer was treating them as if they were defaulter.

At the back drop of this episode, it may be mentioned that there is Rajat Heights Complex (residential cum business) constructed by Rai Group of Industries (Kishor Rai), near Hotel Havens, on Koradi Road. The complex has two buildings. The first building has 128 flats and 120 shops while the second building has 68 flats.

Builder Kishor Rai forcefully collected service tax from flat-owners (as per area of flat) to the tune of Rs 8.5 lakh and society membership (Rs 1000 from each member) to the tune of more than Rs 20 lakh, without providing any receipt to that effect. He collected service tax and society membership between year 2005 and 2006. The builder neither made complete development of the complex nor formed society from the so collected money. Many a time the delegation of flat-owners met the builder but he paid no heed to them and their grievances.

The residents had brought the matter to the notice of IT department and demanded that the Builder be directed to hand over to the society the money collected by him in the name of service tax and society membership along with interest accrued on it. As a result, the IT department called called the residents for hearing. All eyes are still waiting as to what action IT taken into their grievances.
