Nagpur: During the hearing of the suo motu public interest litigation (PIL) against State of Maharashtra and others, Justice Avinash Gharote and Justice Mukulika Jawalkar, at the Nagpur Bench of Bombay High Court here, have directed the respondent State Government to file affidavit by January 18 next regarding the steps taken by the High Court-appointed Committee tasked with clearing the area around the Government Medical College & Hospital (GMCH), Nagpur, of all encroachments.
The High Court has given oral directions in this regard after perusing the note submitted by the amicus curiae, Anup Gilda, and in response to his complaint that despite the directives issued by the High Court recently, encroachments continue near the main gate of the GMCH, obstructing the movement of persons and vehicles going to and out of the Government Medical College & Hospital.
The High Court had appointed the said Committee through the order passed by it on September 21, 2023 to look after and handle the concerns of the citizens in this regard.
Additional Government Pleader (Addl. GP) Deepak Thakre and Special counsel, Firdos Mirza appeared for the State.
Earlier, the High Court had expressed deep concern over the growing encroachments in front of the main gate of the GMCH. In response to this issue, the court had issued directives to the Nagpur Municipal Corporation (NMC) to ensure the removal of these encroachments by November 30 last year.
A significant aspect of the proceedings involved a grievance about encroachments that impede the passage of ambulances through the main gate, posing potential risks during emergencies. The matter had been previously considered in the court’s order on September 21, leading to the formation of a committee tasked with addressing the encroachment issue. The urgency to remove these obstacles aligns with the court’s commitment to ensuring the smooth functioning of medical facilities and emergency services at GMCH.
