A delegation of Chamber of Associations of Maharashtra Industry & Trade (CAMIT) led by President, Dr Dipen Agrawal, met Dy. Chief Minister, Dr Devendra Fadnavis and expressed gratitude on behalf of stakeholders from Nagpur and Amravati for notifying Abhay Yojna for Nazul-land leased for residential purpose and reducing premium from 5% to 2% of ready reckoner rate for converting to freehold.

At the outset Dr Dipen Agrawal felicitating Dy. Chief Minister with Shawal and flower bouquet and submitting a memorandum, upraised him that Nazul-land is also leased for commercial use and the original proposal as envisaged in 2019 by him provided for converting the Nazul-land leased for commercial purpose to freehold on payment of 10% premium as against 5% premium for Nazul-land leased for residential purpose. Dr Agrawal request DCM to revisit the matter and give the benefit of the instant Abhay Yojna to Nazul-land leased for Commercial purpose on payment of premium at 4% of ready reckoner rate on parity basis.

DCM, Dr Fadnavis, informed the delegation that his government is working to achieve the goals of ease of doing business and cost of doing business as envisaged by our beloved Prime Minister, Narendra Modi and assured to take up the matter on priority basis.

Sanjay Nabira upraised DCM that on government directions in 2019, Municipal Corporations across the state increased the lease rent to 8% of property value for leaseholders and also for licensee galedharak. Taking cognisance of widespread protest, the then state government, on your intervention, stayed the effect of the 2019 GR. After review new rules were notified wherein minimum lease rent of 0.50% of market value for residential, educational, charity and public purpose and 0.70% of market value for Commercial and Industrial purpose has been notified with a cap that increase cannot be more than twice the lease rent applicable in 2019. Few Corporations namely Kolhapur, Jalgaon & Nashik had exorbitantly increased rent prior to issuance of 2019 GR.

Ashok Shanghvi, president of Nagpur General Merchants Association upraised DCM, Devendra Fadnavis that leaseholders even after enjoying greater benefits would be paying less rent whereas the licensee galedharks enjoying lesser benefits as compared to leaseholder would be paying higher rent (about 4% in Nagpur and about 8% in other Corporations). He requested DCM to intervene and direct UDD to notify that the GR dated 06/11/2023 apply mutatis mutandis to Licensee Galedhark or alternatively notify similar rules for Licensee Galedharak of Corporations, and stay the exorbitant increase in rent by Kolhapur, Jalgaon and Nashik Municipal Corporation prior to issuance of 2019 GR added Dr Dipen Agrawal.

DCM acknowledged that there is need to rationalise rent for licensee galedhark and assured that his government is working on it.

Natwar Patel informed DCM that in 2018 Final Development Plan (2012-2032) for Nagpur Metro Region was sanctioned and notified, and since then the Micro, Small and Medium Enterprises (MSME) in the rural part of Nagpur district are in doldrums. They are running from pillar to pillar, authority to authority highlighting their plight. Patel further informed that first notification declaring 5 Km area touching outer limits of Nagpur Municipal Corporation (NMC) as Nagpur Metro Region was issued in 2019 and thereafter the Metro Region limit was increased to 10 Km before notifying the present limit of 25 Km from boundary of NMC. In the year 2010 Nagpur Improvement Trust (NIT) was notified as Special Planning Authority for Nagpur Metro Region the limits and thereafter in 2012 NIT passed resolution for preparing development plan for Metro Region. NIT published Draft Development Plan (2012-2032) calling objection and suggestions, in 2015, in the meantime, state government established Nagpur Metropolitan Region Development Authority (NMRDA) in 2017. The 2018 notification, notifying the sanction of DCPR expressly stipulates that the sanctioned DCPR shall come into force from the date one month after its publication in the official gazette, meaning thereof the said DCPR is prospective in operation and not retrospective, Patel emphasised.

Dr Dipen Agrawal requested Dy. Chief Minister to protect the MSME units established prior to 06/01/2018 (the date on which the DCR 2012-2032 for Nagpur Metropolitan Region was notified) from the retrospective implementation of the said DCR. He also impressed upon Dr Fadnavis to announce an amnesty scheme to regularise the units if they comply with the then development regulation when the concerned unit was established. And announce an amnesty cum compounding scheme for the other units established before 06/1/2018.

DCM, Dr Devendra Fadnavis assured the delegation to resolve the issue in the best interest of all concerned.
