HC sees red over tardy progress of Cancer Hospital at Nagpur GMCH

Nagpur: Justice Avinash Gharote and Justice Mukulika Jawalkar at the Nagpur Bench of Bombay High Court have sought a statement from the Government Counsel after taking appropriate instructions, regarding status of construction of Cancer Hospital in the premises of the Government Medical College and Hospital (GMCH), Nagpur, on February 29 next.

The High Court took quite a serious note of information received from the Amicus Curiae Anup Gilda, that though the work order for construction of the Cancer Hospital was given in April 2023, the work is going on ‘at a snail’s pace’ and considering that the linear accelerator will be installed therein and which would be available by March next, may give rise to very difficult situation, if the building is not completed, as Adv. Gilda has informed that the said construction is at a preliminary stage as only the pits for laying the foundation have been dug.

The HC has directed the Nagpur Municipal Corporation’s counsel Sudhir Puranik to make a statement regarding the status of construction and to ensure presence of the contractor’s representative along with the concerned officer of the newly added respondent-15, the Superintending Engineer, NMRDA, on the next date, February 29, 2024.

During hearing of the suo motu PIL regarding the infrastructural needs and other requirements relating to machines, equipment and medicines of the Government Medical Colleges in Vidarbha in general and in Nagpur in particular, the issue of land for permanent police post engaged the attention of the HC. The land at Serial No. 5 in the Map, which is owned by the NMC and is just outside the boundary wall adjacent to the main entry gate of the GMC has been identified for setting up the police post.

It was intimated to the HC that the area of the land — 150 sq.ft. — is quite small and an area larger than that is required. In the light of this, the HC directed the State Government to initiate a dialogue with the occupant of Zunka Bhakar Kendra and as a temporary measure shift that behind the existing blocks indicated by the Figure 1 in the Map, so that the area occupied by it can then be utilised for erection of a larger permanent police post which would cater to the traffic outside the Hospital as well as to the issues inside it.

In any case this area of 150 sq. ft. should be made immediately available by the NMC to the Police authorities. The NMC counsel agreed that this would be done by Friday. If that happens the erection of the Police Post can be completed by February 25 next and compliance can be reported on February 29. The Court also wants that the result of talks with Zunka Bhakar Kendra be reported to it by that date, to enable the Court to pass final orders in this regard.

The NMC counsel informed the HC that regarding shifting of Hawker Zone, meeting of Town Vending Committee has taken place and the result thereof would be placed before the Court by the next date. After hearing the concerned parties, the High Court expressed hope that solarization of the street lights as directed would receive priority and be completed as early as possible in three months and a progress report about this should be placed before the Court by the next date.

Special Counsel for the State Government Firdos Mirza agreed to verify the position regarding multiple level parking project and three washrooms and waiting sheds in the light of the suggestions made by the Court and make a statement about this on the next date. Additional Government Pleader Dipak Thakre informed the HC after receiving instructions from the Maharashtra Security Board official present in the Court that the exercise of identifying 301 Security Guards shall be completed by February 27, and in case Rs 2.5 crores are deposited in the Security Board’s account, towards salary of three months for these Guards by February27, the actual deployment of those guards would be made from March one next.
