Nagpur: On the basis of the affidavit tendered by the respondents State Government and others’ counsel during hearing of the suo motu PIL — C H Sharma & Others v State Medical Education & Drugs Secretary and others, Justice Avinash Gharote and Justice Mukulika Jawalkar, at the Nagpur Bench of Bombay High Court, have noted that now about Rs 18.49 crore are available with the Government Medical College Hospital (GMCH), Nagpur, for procuring the machines and equipments as per the new list.
The HC has further noted that this list speaks about equipments and machines, which are needed now, the total cost of which is Rs 19.16 lakh. In view of urgency prayed for by the respondents’ counsel Firdos Mirza, the HC has directed the State Government and other respondents to take appropriate steps immediately to start the process of procurement of these equipments, machines/medicines forthwith and to ensure that those stand procured by March 25, 2024, and an affidavit reporting compliance be filed in the Court by March 27 next.
Additional Government Pleader, Dipak Thakre assured the Court that any difference between the amount available with the GMCH and the amount required for procurement shall be endeavoured to bridge by the respondent Collector, Nagpur, from whatever funds are available with him. The HC has further directed the respondents to start the process of procurement immediately and to ensure completion of tender process by March 25 next with compliance report by March 27.
The HC has also directed the State Govt. to take final decision regarding deployment of additional security guards by January 31, 2024. Further the HC has directed initiation of procurement process for acquiring Digital Cardiac Cath Lab for GMCH and to complete that by March 25 next.
In respect of removing the encroachments in the area near the main gate of the GMCH, the HC has directed the NMC’s counsel Sudhir Puranik to place on record in tabular form the details of the area granted on leave and licence in respect of 42 blocks by January 25 next along with the copies of the licenses so that suitable directions can be issued in that regard. Till that time, the City Corporation has been directed not to permit any construction of whatsoever nature in or around these blocks.
Further, the High Court has asked the NMC and the Town Vending Committee to revisit the location identified by it as an area measuring 804 Sq. meter opposite the main GMCH gate as Hawkers’ Zone and decide upon another area to shift and relocate the said Zone away from the Hospital. The Municipal Commissioner has been directed to take an appropriate decision in this regard by February 15 next. The PIL will be before the Court for further hearing on January 25 next.
