Judge Loya case: Petitions filed with oblique motive to scandalise judiciary, SC told

Justice LoyaNew Delhi: The petitions filed on the death of judge Loya are with an oblique motive to scandalise the judiciary, the Maharashtra government on Monday told the Supreme Court. This is an attempt to take undue advantage of the unfortunate death of a judge, Maharashtra also contended.

Further it was also stated that all in the SC are arguing as if it were a murder trial. Further it also said that if the SC wants to reject the statements of the judges who said that judge Loya’s death was natural, then it has to be prima facie accepted that they were conspirators in the case.

Arguing for Maharashtra, senior advocate, Mukul Rohatgi said that everything is being based on an unconfirmed article. None of them even lifted a finger to verify the allegations made in the article which was written 3 years after the death of Loya. Moreover unconfirmed articles in the media do not form legally admissible evidence, he also stated.

Meanwhile Dushyant Dave arguing for the petitioners sought for a copy of the communication sent by the Commissioner Intelligence to the judges for their statements on the judge’s death. Rohatgi told Dave that he has not seen those copies. He also said he would provide them. Further hearing on the matter has been posted for Friday.
