Power Tussle: NCLAT dismisses appeal filed by Ramavtar Totla, Ashwin Mehadia

Nagpur: Observing that, the appellant Ramavtar Totla and Ashwin Mehadia had filed a complaint without any knowledge of the Administrator, the National Company Law Appellate Tribunal (NCLAT) has dismissed the grievance raised by the latter.

Following which the Nag Vidarbha Chamber of Commerce (NVCC) had to withdraw their Company Appeal (AT) 31 of 2023.

The appeal was filed without consent and approval of Administrator appointed by NCLT through their order on January 31, 2023, resulting in Contempt of NCLT due to willful disobedience of the said order.

The administrator has directed Ramavtar Totla and Ashwin Mehadia to explain, under whose authority the appeal was filed by NVCC when the board is suspended and further directed to withdraw the said appeal.

Hence the said appeal was Dismissed as Withdrawn by NCLAT.

NCLAT also dismissed the Company Appeal (AT) 30 of 2023 filed by Ashwin Mehadia as withdrawn with liberty to approach NCLT within next two weeks.
