The complainant, Ravi Dikondwar, claimed that he was the owner of two shops located on khasra no 109. He alleged that he was summoned to Ranjeet’s office, where he was informed about the purchase of land behind his plot.

According to Dikondwar, he was coerced into surrendering his two shops for the sale of plots. Subsequently, he asserted that he faced life threats when he demanded rent and eviction, leading to the accused illegally occupying his blocks.

The Assistant Public Prosecutor (APP) presented nine witnesses and argued that sufficient evidence, including cellphone recordings supported by a certificate under section 65b of the Evidence Act, warranted a conviction.

The prosecution insisted that the matter was criminal in nature. Advocates Prakash Jaiswal, Ashish Nayak, Gazala Khan, Avinash Balpande, Sushmita Jaiswal, and Akash Safelkar represented the accused. They contended that the dispute was essentially a civil matter falsely implicated as a crime by the police.

The defense pointed out the absence of phone recovery and questioned the complainant’s ownership of the disputed property, asserting that the case relied on unreliable evidence.

The JMFC 3rd Court, after considering arguments from both sides, acquitted all the accused. Advocate Prakash Jaiswal, Adv Ashish Nayak, Adv Gazala Khan, Adv Avinash Balpande, Adv Sushmita Jaiswal, and Akash Safelkar appeared for Ranjeet Safelkar and Rakesh Kale, while Adv Ravi Rajkane represented Sanjay Korde, and Adv Masurka appeared for Ajay Channor.
