Rashmi Barve caste validity case: SC dismisses SLP filed by State Govt

Nagpur: The Special Leave Petition (SLP) filed by the State Government in the Supreme Court of India, challenging the ruling of Nagpur Bench of the Bombay High Court in the caste case related to former Zilla Parishad President Rashmi Barve, has been dismissed by the top court on Friday, October 18.

The Supreme Court bench of Justice B R Gavai and Justice K V Vishwanathan dismissed the SLP filed by the State Government against the order of the High Court.

During the hearing the Supreme Court came down heavily on the Caste Scrutiny Committee, Nagpur, for their conduct and the manner in which the caste certificate and the caste validity certificate of Rashmi Barve was invalidated in a period of 9 days.

It may be mentioned that the High Court had quashed the decision of the District Caste Certificate Scrutiny Committee (CSC), which had cancelled the caste validity certificate of Rashmi Barve, on September 24. The Court had stated in the order that the CSC had no jurisdiction to reopen Rashmi Barve’s case without substantial evidence and directed the Caste Scrutiny Committee to issue the petitioner’s validity certificate within a week and pay the imposed cost.

Advocates Dama Sheshadri Naidu, Sameer Sonwane, Shailesh Narnawre, Amit Thakur, Aaquid Mirza and Shiba Thakur represented Rashmi Barve. Tushar Mehta, Solicitor General of India and Aaditya Pande represented the State Government.
