Nagpur: In a setback to Nagpur police, the Special Judge (MCOCA), Manjusha V Deshpande, has acquitted six accused involved in the spree of chain-snatchings in Kamptee area. The acquitted accused were facing charges under Sections 395 of the Indian Penal Code and Section 3(1)(ii), 3(2), and 3(4) of The Maharashtra Control of Organized Crime Act, 1999 (MCOCA).
The case stemmed from an incident reported by Babibai Lakshane, who alleged that on the morning of September 13, 2020, while walking near Dahibazar over bridge, two persons on a motorcycle snatched her gold chain. The New Kamptee Police had arrested seven persons in this case. The police had invoked MCOCA against Hayder Ali Yusuf Ali (30), Yusuf Ali Ameer Ali (dead), Jasim Ali Mehandi Ali (54), Mohd Owais Mohd Shahid (20), Shabbir Ali Salim Ali (35) and Nadir Jaidi Talib Jaidi (46), all residents of Kamptee.
The prosecution relied on circumstantial evidence, including CCTV footage, identification parades, and confessional statements, to build its case against the accused. However, after a thorough examination of the evidence presented, Judge Deshpande ruled that the prosecution had failed to establish the guilt of the accused beyond a reasonable doubt and acquitted Hayder Ali Yusuf Ali, Mohsin Raja Gulam Raja, Jasim Ali Mehandi Ali, Mohd Owais Mohd Shahid, ShabbirAli Salim Ali and Nadir Jaidi Talib Jaidi.
The Judge underlined the need for circumstantial evidence to unequivocally point towards the guilt of the accused, which, in this case, was not met.
Adv Ravindra R Rajkarne and Adv Chetan Thakur represented the accused persons while APP Kolhe represented the State.
