Nagpur: A Special Court for CBI cases in Nagpur sentenced a Manager (Finance) and a former clerk of Western Coalfields Limited (WCL) to five years imprisonment on Monday after substantiating charges of corruption against them.
Manik Lal Paul, Manager (Finance) at WCL’s Neeljai Sub Area, and Avinash Marotrao Kakde, a former Clerk (E&M) at WCL’s Neeljai North Open Cast Mine, were sentenced to five years rigorous imprisonment (RI) and five years simple imprisonment, respectively. Both were also fined Rs 5,000 each.
The prosecution revealed that the Nagpur-based Anti-Corruption Branch of the Central Bureau of Investigation (CBI) had registered a case against the accused, alleging that Paul and Kakde demanded and accepted bribes in exchange for processing bills related to the repair and RTO passing of an ambulance (MH-34/A-1642) owned by complainant Vasim Aziz Khan. Khan had refused to pay the bribe and subsequently lodged a complaint with the CBI on May 6, 2014.
Following the complaint, CBI officers laid a trap and caught both Paul and Kakde red-handed while they were demanding and accepting the illegal gratification from Khan. The CBI then investigated the case thoroughly and filed a chargesheet against the two under Sections 120-B of the Indian Penal Code (IPC), along with Sections 7, 13(2), read with Section 13(1)(d) of the Prevention of Corruption (PC) Act, in the court of the Special Judge, Nagpur.
After the charges were substantiated, the court sentenced Paul to five years of rigorous imprisonment under Sections 7, 13(2), read with Section 13(1)(d)(I) of the PC Act. Kakde was sentenced to five years of simple imprisonment. Both convicts were also ordered to pay a fine of Rs 5,000 each.
