Nagpur: Judicial Magistrate First Class Ms G N Bagrodia in Nagpur sentenced Dinesh Ramdeo Shahu (21) to one year imprisonment for causing the death of a middle-aged man by negligence in a road accident case.
Interestingly, the verdict comes from the JMFC court after the death of Capt Dilip Chandrasen Bargal (56) 19 years ago in the road mishap that took place in Gittikhadan area. Capt Bargal was going towards the headquarters of Western Coalfields Limited from TV Tower Square on a Honda Eterno around 11 am on January 4, 2005.
A resident of Kachipura, Shahu, who was riding a TVS Victor motorcycle (MH-31/M-626) in rash and negligent manner, hit Capt Bargal’s vehicle. Capt Bargal fell off the vehicle and received serious injuries. He was rushed to Mayo Hospital but on the way, he succumbed to his injuries.
Following a complaint lodged by Chanda Tukaram Bargal (45), cousin of Capt Bargal and a resident of Hanuman Nagar, Gittikhadan Police registered a case under Sections 279, 337,427 and 304(A) of the Indian Penal Code against Shahu. On January 8, 2005, police arrested Shahu. Head Constable Suresh Choudhary investigated the case and filed a chargesheet against Shahu. As the charges were substantiated against Shahu, the court awarded him one year imprisonment with a fine of Rs 3000 for the offence under Section 304(A) of the IPC.
The court also sentenced him to three months imprisonment for the offences under Sections 279, 337 and 427 of the IPC.
